By accessing or using Emotionle, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.

Emotionle is not a medical or healthcare service. The App provides general wellness content and exercises that may help manage everyday stress and anxiety. The App does not provide medical advice, diagnosis, or treatment.

While Emotionle aims to provide helpful exercises for managing stress and anxiety, we make no guarantees regarding the effectiveness of these exercises for any particular user. Results may vary significantly between individuals.

References to potential emotional changes or improvements within specific timeframes (such as "positive emotional changes in 2 weeks") are general statements based on research and are not guarantees or promises of specific outcomes for any individual user.

Your results from using Emotionle depend on many factors outside our control, including but not limited to your consistent practice, individual circumstances, overall mental health, and whether you are simultaneously receiving professional care.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMOTIONLE AND ITS CREATORS, OPERATORS, AFFILIATES, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY REFERENCED BY OR LINKED THROUGH THE APP;
• ANY EMOTIONAL DISTRESS, PSYCHOLOGICAL EFFECTS, OR CHANGES IN MENTAL STATE RESULTING FROM USING THE APP;
• ANY DELAY OR FAILURE IN SEEKING PROFESSIONAL MEDICAL ATTENTION DUE TO RELIANCE ON THE APP;
• ANY CONTENT OBTAINED FROM THE APP; AND
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA STORED LOCALLY ON YOUR DEVICE.

In no event shall our total liability to you for all claims related to the App exceed the amount paid by you, if any, for accessing the App. Since Emotionle is provided free of charge, this means our maximum liability is £0.

This limitation of liability section applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

Indemnification

You agree to defend, indemnify, and hold harmless Emotionle and its creators, operators, affiliates, partners, and licensors from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the App.

Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Emotionle and its licensors. The App is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Emotionle.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will function uninterrupted, secure, or available at any particular time or location;
• Any errors or defects will be corrected;
• The App is free of viruses or other harmful components;
• The results of using the App will meet your requirements;
• The App will improve your mental health or wellness.

This disclaimer of warranty applies to the maximum extent permitted by applicable law.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Your use of the App may also be subject to other local, state, national, or international laws.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
